1. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The application arises out of incident which is said to have occurred at [ ] Nightclub, [ ] on the [ ] at approx. [ ]. In her application form the Applicant describes an incident whereby she was present at the nightclub in question when she was assaulted by a person known to her. She suffered a broken nose as a result of the incident. She confirms that the incident was reported to Garda [ ] of [ ] Garda Station who investigated the matter. The Applicant states that she was transferred from the incident locus to [ ]. She was later referred to [ ] Hospital and was required to have an operation on her nose. The Applicant’s legal representatives state that as a result of the incident the Applicant incurred financial loss in respect of her employment. They state that she was absent from work for a two week period and she earned €400 per week. Further, they state that she was unable to travel on a holiday which she had booked prior to the incident.
3. An Garda Siochana confirm that no compensation was paid by the offender to the Applicant. The Applicant has no criminal record.
4. No vouching documentation has been submitted in support of this application other than a prescription claim form in the sum of €3.65; a further prescription claim form in the sum of €33.90; a photocopy of an invoice from [ ] Hospital in the sum of €60; a receipt from the [ ] Clinic in the sum of €20 and a note of a booking made by [ ] with [ ].
5. On the [ ] this Tribunal wrote to the Applicant’s legal representatives seeking original receipts and vouching documentation with regard to out of pocket expenses. No response was received to that request. In circumstances whereby no reply has been received I am satisfied that this claim has not been maintained by the Applicant, and no award is made.
