The Applicant submitted that on the [ ] he was out drinking with some friends when he was assaulted suddenly in an unprovoked attack by one of the other people he was having a drink with. The Applicant submits that he was unconscious on the floor and he was told later by one of his friends that the assailant picked him up by the belt and shoulders and threw him against the wall. The Applicant submitted he was unconscious for a long time and when he regained consciousness he could not move because his whole body was so sore. He was brought to hospital where he was informed that nothing was broken but he stayed there as an inpatient for two days. Two days later he was in extreme pain and was brought to hospital where ambulance where he was told he needed surgery on his neck where he had to have a steel bar implanted in his neck. As a result of the incident the Applicant has suffered problems with his right hand and his right leg. Paragraph 21 of the Scheme provided:
“Applications should be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury”.
The application was received outside the three month time limit, and the Applicant did not provide any information for the Tribunal to conclude that exceptional circumstances existed so as to extend the time to allow for his application. In the circumstances the Tribunal makes no award.
