1. Mr. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The incident occurred on the [ ]. The Applicant states in his application form that on the date in question he was in the company of a number of friends having travelled to [ ] to celebrate [ ]. He states that on the morning of the [ ] he and his friends left the [ ] Bar to seek a taxi to return to the premises where they were staying. He states that he and his party were set upon by a number of assailants. He states the assailants appeared to be drunken or on drugs. He was attacked from all sides and the next memory he has is his being woken by a nurse at [ ].
3. The Applicant reports that he suffered a broken jaw in two places. He required five stitches to his right eye and had a scar on his forehead together with nerve damage to his chin. It is noted on his application form the Applicant’s states that he is making a claim for loss of earnings. In respect of out of pocket expenses the sole voucher which the Applicant has submitted to this Scheme concerns a pharmacy receipt in the sum of €38.96 and a note of the prescription upon which the receipt is based.
4. No further documentation has been received from the Applicant in respect of out of pocket expenses incurred. Further, no particularisation of the Applicant’s claim for loss of earnings has been made and no documentation submitted in this regard.
5. To that end I expressly note that this Tribunal wrote to the Applicant requesting that this documentation be provided no later than the [ ]. It is apparent that no response was received from the Applicant in respect of this request. I note that the Applicant was previously requested to submit these particulars of claim together with the documentation requested on the [ ] and again no response appears to have been received to that correspondence. In circumstances whereby the Applicant has failed to prosecute his claim and submit the required documentation and details of loss of earnings this application is dismissed.
6. No award is made.
