1. [ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’) on the [ ].
2. The incident at issue occurred on the [ ] wherein the Applicant was assaulted at [ ]. The Applicant states that the incident occurred at 5.36 p.m. The offender in question was identified. The Applicant states that as a result of the assault he suffered a severed artery and loss of feeling in his hand. The Applicant states he lost work opportunities due to the level of injury sustained. He has also stated in his application form that he has suffered out of pocket expenses in respect of hospital attendances and medication. An Garda Siochana confirm that the incident took place as outlined on the application form.
3. No vouching documentation has been submitted by the Applicant in respect any out of pocket expenses claimed on his application form. Further it noted that the Applicant has not submitted a vocational assessment report or indeed any details of any loss of earnings which he claims to have suffered as a result of his injury. Further it is expressly stated in section 1(f) of the Applicant’s application form that he is unemployed however he was due to start a FAS course on the [ ] and was unable to do so.
4. It is noted no particulars of this FAS course or any vocational assessment has been provided. In the absence of any evidence this Tribunal is not in a position to make any award in respect of this application.
5. Finally, it is noted that on the [ ] the Criminal Injures Compensation Tribunal wrote to the Applicant’s representatives requesting that all documents to be relied upon and full particulars of claim be submitted no later than the [ ]. No response was received to this correspondence.
6. In these circumstances the application is dismissed and no award is made.
