1. The applicant in his application form outlines that he was assaulted on [ ]. He states that he had [ ] and a detached [ ]. The gardaí were at the scene and on [ ] the applicant made a statement. On [ ] the applicant retracted his statement to the gardaí and sought that no further garda action was taken in the matter.
2. Paragraph 21 of the Scheme provides “applications should be made as soon as possible but, except in circumstances determined by the tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury.”
3. The application in this matter was received by the tribunal some 33 months after the incident. The applicant states in his application that he did not know about the Scheme until told by the VHI and it was the VHI that recommended he make an application.
4. This application was made almost 30 months outside the time limit for applications. I am not satisfied that the explanation from the applicant amounts to circumstances that justify exceptional treatment. The time limit is not extended and I make no award.
