On the [ ] the Applicant was walking down [ ] in [ ] when he was suddenly hit in the back of the head with what he believed to be a bottle. As he turned around he received a blow to the face which caused him to fall to the ground. As a result of the assault the Applicant was left unconscious. An ambulance was called and the Applicant was taken to hospital. The Applicant received inpatient treatment from the [ ] to the [ ] and outpatient treatment from the [ ] to the [ ]. As a result of the incident the Applicant received two steel plates, one in his chin and one in his jaw. The Applicant submitted that his take home pay before the incident was €440 per week and that he estimates his loss of earnings at €3,520. The Applicant received €124 per week in disability benefit. The matter was reported to An Garda Síochána. The Tribunal did not receive any medical reports or any vouching documentation in respect of expenses incurred as a result of the incident. The Tribunal wrote to the Applicant on the [ ] requesting further information in respect of the incident from the Applicant including a medical report from the Accident and Emergency Department that treated the Applicant. On the [ ] the Tribunal indicated to the Applicant’s solicitor that it would require documentation from the Applicant’s employers outlining his absence from work and any loss of earnings. The Tribunal did not receive any further information from the Applicant in respect of the claim. In circumstances where there is no vouching documentation in respect of the alleged loss of earnings the Tribunal makes no award.
