On the [ ] in [ ] the Applicant received a slash wound to the left side of his face from a Stanley blade. A male had approached him attempting to steal his bicycle and when he did not hand the bicycle over the male took out a Stanley blade from his pocket and slashed the left side of the Applicant’s face. This was an unprovoked attack. The Applicant has no criminal convictions and he has been left with a permanent scar along the whole left side of his face approximately 10 centimetres in length.
The offender was never brought before the Courts and no compensation was paid to the Applicant in respect of the incident. The Applicant submitted in his application form that he suffers from anxiety and depression as a result of the incident and he has suffered a loss of confidence. The Applicant was unemployed at the time of the incident but believes that he would have secured employed but for the scar now present on his face. The Applicant submitted that it will be very difficult for him to get a job with such a scar across his face.
In circumstances where the Applicant was on social welfare at the time of the incident and no details have been submitted in respect of what job prospects the Applicant had and/or what training the Applicant had in order to secure employment, the Tribunal has been furnished with insufficient information to conclude that the Applicant has suffered any loss of earnings. The terms of the Scheme do not allow for compensation for general damages. In the circumstances the Tribunal makes no award in this instance.
