1. The applicant’s claim to the tribunal relates to an injury he sustained to his arm.
2. He states in the application form that he reported the matter to a member of An Garda Siochana.
3. The applicant’s application form and some associated documentation was received on [ ].
4. The tribunal wrote to the applicant on [ ] and acknowledged receipt of the application. The tribunal requested further information from the applicant.
5. On [ ] the tribunal received further documentation from the applicant.
6. On [ ] the tribunal wrote to the applicant and enquired whether he wished to pursue his application. The tribunal did not receive a response.
7. Paragraph 11 of the Scheme provides that “no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise.”
8. From the documentation submitted to the tribunal it is not possible to determine the extent of the applicant’s claim. While certain letters, pay slips and social welfare receipts are on file there is no explanation of the loss claimed by the applicant. The invoices from hospital are not paid.
9. The applicant has failed to engage with the tribunal in relation to his claim. I am of the opinion that all reasonable assistance has not been provided to the tribunal in relation to this application. It is for the applicant to establish his case and that has not been done. I make no award.
