1. Mr. [ ] (‘the Applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. The Applicant states in this application form that the incident occurred at [ ]. He states that he left a [ ] at approximately [ ] when he was assaulted and suffered a stab wound to his [ ] hip and a slash to his [ ] forearm. As a result of his injuries, he was required to attend [ ] Hospital.
3. The Applicant states that at the date of the incident he was employed as a [ ]. He states that he suffered loss of income in the sum of €50 per night for a period of seven weeks as a result of the incident.
4. The Applicant also states that he suffered psychological sequalae as a result of the incident.
5. The application was acknowledged as received by the Tribunal on the [ ], and a report was requested from An Garda Siochana on the [ ]. Correspondence had also been received from, what appears to be the Applicant’s constituency representative, then [ ], [ ], on the [ ], requesting that the application be progressed expeditiously.
6. The Applicant advised the Tribunal by letter dated the [ ], that criminal proceedings had been finalised at the [ ] sittings of [ ] Circuit Criminal Court and a report was produced by An Garda Siochana in relation to the matter. The said report was received on [ ] and accords with the Applicant’s account of the injuries and confirms that the Applicant was of good character and no previous convictions.
7. The Applicant wrote to the Tribunal by way of response to the Tribunal’s correspondence dated the [ ], advising that he did wish to progress his application to the Tribunal. The Applicant was unsure what vouching documentation was required to be submitted. He refers to the significant psychological impact the incident has had upon him. The Applicant encloses a copy of his P21 balancing statement for the tax year [ ].
8. An Garda Siochana report that the Applicant has [ ] previous convictions, all road traffic offences. The last conviction was recorded on the [ ] at [ ] District Court where he received a [ ], a charge of [ ] was taken into consideration. At [ ] District Court on the [ ] charges of [ ], [ ] and [ ] were taken into consideration. The Tribunal provided a copy of this report to the Applicant on the [ ], for his comments thereon and no response appears to be received thereto.
9. Finally, on the [ ], the Tribunal wrote to the Applicant advising that if no response was received they would pass this application to a Tribunal member for a decision.
10. In the absence of the provision of sufficient information by the Applicant in this case it is not possible to make a determination in relation to the matter as the Applicant has not provided information in relation to loss of earnings nor his previous convictions as advised by AGS, nor has, he provided sufficient vouching documentation for out of pocket expenditure.
11. Pursuant to paragraph 10 (previously paragraph 11) - No award is made.
