1. Mr. [ ] (on behalf of [ ] (Deceased) ('the Applicant') has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted ('the Scheme' ).
2. A report has been received from An Garda Siochana in relation to the matter which confirms that the Deceased was [ ] by way of a violent incident which occurred at [ ] on the [ ] at [ ]. The application was submitted by the Deceased's son who has provided details of the siblings who are stated to be the sole dependents of the Deceased.
3. By way of a letter dated the [ ], the Applicant's solicitors stated that there were difficulties obtaining instructions given a language barrier. The matter appears to have lay dormant for a period of [ ] years when the then Chairperson noted that the file, having been so dormant, required a warning letter to be sent to the Applicant's solicitors. The said warning letter issued on the [ ], and no response was received thereto. Further correspondence was issued on the [ ]. A response was received thereto on the [ ], confirming that the said solicitors wished to take instructions. No further response was received from the said solicitors. On the [ ], the Tribunal wrote to the said solicitors advising that should no response be received the application would be placed in 1ine for a decision by a Tribunal member.
4. In the absence of full particulars to include Birth Certificates of the statutory dependents of the deceased and the absence of any vouching documentation it is not possible to proceed to make an award in this case. Therefore, no award is made.
