Consultation is closed

On behalf of the applicant – the Minister for Public Expenditure and Reform (the “Minister”), Paschal Donohoe TD – the Brexit Unit of the Office of Public Works have submitted an application to An Bord Pleanála for approval under Section 181(2A)(b) of the Planning and Development Act 2000 (as inserted by regulation 4(b) of the European Union (Environmental Impact Assessment and Habitats) (Section 181 of the Planning and Development Act 2000) Regulations 2019 (SI No. 418 of 2019)).

In regard to the proposed development located within the existing boundary of the Harbour of Dublin Port Company, the Minister is satisfied that it is required by reason of an emergency, being the exceptional circumstances arising as a result of the withdrawal of the United Kingdom from membership of the European Union.

The Minister has considered whether an environmental impact assessment or an appropriate assessment is required in respect of the proposed development and, having had regard to Part X and Part XAB of the Planning and Development Act 2000 (as amended), is satisfied that both such assessments are required.

In accordance with the decision of the Board, the Minister proposes to make an Order under Section 181(2)(a) of the Planning and Development Act 2000 (as amended) to provide that the Act shall not apply to the proposed development.

A full description of the proposed development is contained within the documentation and drawings attached herewith.

Submissions and Observations

Any person may, within the period commencing on Friday 19 June 2020 and ending on Monday 20 July 2020 make a submission or observation in writing to An Bord Pleanála, 64 Marlborough Street, Dublin 1, relating to the likely significant effects on the environment and or adverse effects on the integrity of a European site, as the case may be, of the proposed development, if carried out. Submissions or observations duly made will be considered by An Bord Pleanála in making a decision on the application.


Public consultation period and locations

A copy of the application, including a draft of the order the Minister proposes to make under section 181(2)(a) of the Planning and Development Act 2000 (as amended), the plans, drawings and particulars in relation to the proposed development, the Environmental Impact Assessment Report and the Natura Impact Statement, may be inspected free of charge or purchased on payment of a specified fee (which shall not exceed the reasonable cost of making such copy) during public opening hours for a period commencing on Friday 19 June 2020 and ending on Monday 20 July 2020 at the following locations:

  • the Office of Public Works, 52 St Stephens Green, Dublin 2
  • the Offices of the Revenue Commissioners, New Custom House, Promenade Road, Dublin Port, Dublin 3
