The Applicant submitted that on the [ ] he was at home with his brother playing his guitar and relaxing when a [ ] burst through the door and became verbally aggressive. The Applicant submitted that his brother asked [ ] to leave, at which point [ ] became very aggressive and attacked his brother. The Applicant submitted that [ ] broke his guitar off the Applicant’s head and punched him, kicked him and broke his nose, his ribs, his cheekbone and stabbed him with a knife. He also grabbed a saucepan and a frying pan and broke them over the Applicant’s head. He also broke the cooker. The Applicant submitted that [ ] returned the next morning and placed a knife across his throat while he was in bed and threatened to kill him if he reported the incident to the Gardaí. The Applicant reported that [ ] is [ ] and that he was in a lot of pain. The Applicant submitted that he had spent approximately €400 on taxis. On the date of the incident the Applicant was unemployed and the Applicant submitted no evidence of any special damages arising as a result of the incident.

The Tribunal sent a letter to the Applicant’s solicitor on the [ ] requesting the Applicant to submit any documentation in respect of the claim by the [ ] and if no response was to be received from that letter that the application would be forwarded to a member for a decision.

In circumstances where there is no evidence that the Applicant suffered any out of pocket expenses or special damages as a result of the incident no award is made.
