Facts

1. The applicant was assaulted outside [ ] in [ ] on [ ]. He received injuries to his head and was brought by ambulance to [ ] where he underwent surgery. The matter was reported to the gardai and a criminal investigation took place. One person interviewed made admissions in relation to the incident.

2. The applicant was a [ ] and missed work as a result of the incident. There are some receipts and other documentation on file however it appears that this information is incomplete.


Engagement with the tribunal

3. The applicant submitted his application along with some supporting documentation. On [ ] the tribunal wrote to the applicant requesting certain information. The applicant subsequently contacted the tribunal by telephone and a further copy of the letter dated [ ] was sent to him. A further letter was sent to the applicant enquiring as to the outcome of the criminal proceedings. No response was received to that letter. The tribunal wrote to the applicant on [ ] enquiring as to whether the application was being pursued however no response was received.

4. Paragraph 11 of the Scheme provides "no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise."


Decision

5. The applicant has not responded to correspondence from the tribunal and am of the opinion that all reasonable assistance has not been provided. It is for the applicant to establish his case and that has not been done. There are gaps in the information provided. I make no award in this matter.
