The Applicant was the victim of an assault in [ ] outside [ ] in [ ]. The Applicant was knocked on the ground and kicked repeatedly in the head. Following the assault he was taken to Accident and Emergency in [ ] General Hospital where he was found to have bruising to his face, two black eyes, a broken tooth and fractured nasal bones. The Applicant never furnished the actual date in [ ] when the assault took place. The Applicant submitted in his application form that he was waiting for the matter to be dealt with in the District Court before proceeding with the matter. The Criminal Injuries Compensation Tribunal did not receive any further detail in relation to the incident and did not receive any vouchers in respect of special damages sustained as a result of the personal injuries sustained by the Applicant. On the [ ] the Tribunal wrote to the Applicant’s solicitors requesting them to furnish any further documentation including original receipts in respect of the claim. The letter warned that if the Tribunal offices did not hear from the Applicant by the [ ] the file would be sent to a member for a decision. No response was received to that correspondence. In circumstances where there is no evidence of special damages arising as a result of the personal injuries sustained by the Applicant no award is made in this instance.
