Criminal Injuries Compensation Tribunal

On the [ ] the Applicant sustained injuries to his nose, cheek, temple and ear. As a result of the injuries sustained the Applicant was required to attend the [ ] Hospital, and also submitted that he attended Dr. [ ] at [ ]. The Applicant did not give any details in respect of the incident or how the injuries occurred.

By letter dated the [ ] the Tribunal wrote to the Applicant and requested a copy of a P60 for the year preceding the incident if there was any claim for a loss of income together with a statement from the Department of Social Protection showing the number of weeks in which benefit was paid as a result of injury. The letter also requested receipts in respect of payments that had been made in respect of the injuries, such as doctors’ receipts. No response was received to that letter and on the [ ] the Tribunal wrote to the Applicant seeking original receipts and vouching documentation in respect of out of pocket expenses arising from personal injuries sustained. No response was received to that correspondence.

In circumstances where there was no evidence that the injuries sustained by the Applicant were sustained due to a criminal act, and in circumstances where there is no evidence that there have been any special damages arising as a result of the injuries sustained by the Applicant, the Tribunal makes no award in this instance.
