Background

[ ] (“the Applicant”) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (“the Scheme”).

The Applicant’s claim is that he was assaulted on [ ] on [ ] as a result of which he suffered a head injury. The Applicant reported the incident to the Gardaí at [ ] Garda Station following the incident. The Applicant was admitted as an in-patient to [ ] Hospital for a number of days for treatment for his injuries and thereafter attended same for treatment as an outpatient. The Applicant claims that he also attended his GP for treatment. The Applicant informed the Tribunal that his doctors had advised, that due to the nature of his injuries, he would need to be monitored.

It is clear that the Applicant had private health insurance at the time of the incident and that hospital costs incurred following the assault of in or around €21,494 out of a €21,706 bill were paid for by his health insurer. The Applicant has stated that he had no loss of earnings, as his employer paid him whilst out on sick leave. On his application form, received by the Tribunal on [ ], the Applicant stated that he was likely to resume work in [ ], initially on a part-time basis.


Applicant’s claim

The Applicant makes a claim for excess medical expenses which have not been covered by his health insurer, all of which have been vouched, including:

1) €430 - outpatient medical attendances

2) €50 - GP attendance on [ ]

3) €230 - brain scan at [ ] Hospital on [ ]

4) €150 - professional attendance [ ] with Dr [ ]

Total: €860


Decision

The Tribunal awards the Applicant the sum of €860 for medical expenses incurred by him following the incident, which occurred on [ ], wherein he sustained personal injuries.

The Tribunal hopes that the Applicant has recovered fully by now from his injuries and wishes him well into the future.
