Facts/brief background

1. [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).

2. By a written decision, dated [ ], Mr [ ], in his capacity as a Single Member of the Tribunal, made an interim award in the applicant’s favour in the sum of €344.77 in respect of outlays incurred.

3. Paragraph 8 of the Scheme, in material part, states as follows:

‘…it will be open to the Tribunal to make an interim award and to postpone making a final award in a case in which a final medical assessment of the injury is delayed.’

4. [ ] adjourned the further consideration of the application pending receipt of a full report from An Garda Síochána and for a medical report to be obtained setting out the extent of the applicant’s injuries and the reasons as to his absence from work for approximately 10 months, from [ ] to [ ].

5. The file was sent to me by the Secretariat to further consider the application.

6. The file had been updated and included an updated medical report from the applicant’s GP, hospital notes and records, the applicant’s pay slips and a report from An Garda Síochána dated [ ].

7. The Garda report confirmed the account of the incident as relayed by the applicant. The medical report, from the applicant’s GP, confirmed the serious extent of the applicant’s injuries and his treatment which he received for them. The GP report confirmed that the applicant was medically unfit for work for approximately 10 months as a result of the assault perpetrated upon him.
