Facts/brief background

1. [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).

2. In her application for compensation under the Scheme, received on [ ], the applicant (who was born on [ ]) outlined that she was assaulted at [ ] on [ ] by a named person. No details of the assault are provided.

3. No medical report was submitted. No vouchers regarding any losses or out of pocket expenses were submitted.

4. No Garda Report was supplied to the Tribunal.


Article 10 – obligation to give all reasonable assistance to the Tribunal

5. The Tribunal wrote to the applicant’s solicitor on [ ] and [ ], seeking further information from the applicant. The firm of solicitors replied under cover of letter dated [ ], notifying the Tribunal that they no longer represent the applicant.

6. By letter dated [ ], the Tribunal wrote to the applicant, seeking further information from her, and also confirmation by [ ] that she wished to proceed with her application. There was no response to this letter.

7. The applicant has not replied to correspondence in relation to her claim before the Tribunal. Therefore, I find that she has not given all reasonable assistance to the Tribunal as required under Article 10 of the Scheme.

8. I therefore decline to make any award.
