On the [ ] the Applicant was walking at approximately 6.20pm in the evening when a man attempted to steal her handbag. The Applicant struggled with the perpetrator, and as a result was dragged across the street. The Applicant submitted that she injured her finger in the process of the assault causing her to be out of work for one week. The perpetrator was later arrested by An Garda Siochana. The Applicant attended [ ] Hospital in [ ] and submitted that there is a left sided curvature of her third finger on the left hand as a result of the incident. The Applicant was absent from work from the [ ] to the [ ]. The Applicant submitted that she lost €427 as a result of being absence of work as a result of the incident. The Applicant submitted that she expended €100 visiting a doctor, €60 in the Accident and Emergency and €149 travelling back to [ ]. The Applicant submitted evidence that she was certified unfit for work from the [ ] to the [ ] inclusive. She also included receipts in the sum of €110 in doctor’s fees. The Applicant submitted two statements from her bank indicating that she had spent €100.77 and €149.73 in [ ]. The Applicant did not fully explain how [ ] relates to the incident in question or what the €100 spent in [ ] relates to.

Paragraph 20 of the Scheme provides “Applications should be made as soon as possible but, except in circumstances determined by the Tribunal to justify exceptional treatment, not later than three months after the event giving rise to the injury. No applications may be accepted by the Tribunal where the event giving rise to the injury took place more than two years prior to the date of application”.

The Tribunal wrote to the Applicant on the [ ] and asked the Applicant to indicate whether she proposed to pursue the application and if so to indicate same to the Tribunal by the [ ]. No response was received to that letter.

The application was received outside the three-month time limit stipulated in the Scheme for submission to the Scheme. No circumstances were outlined that would justify extending the time for application outside of the three-month time limit. In the circumstances the Tribunal makes no award in this instance.
