1. The applicant reported that he was assaulted to the gardaí at [ ] Garda Station. The applicant states in his application form that he had a fracture of his jaw / chin. The applicant has not provided any details in relation to an assault in his application. The tribunal has had no contact from the applicant since the application form was received on [ ].
Engagement with the tribunal
2. The tribunal has had no contact from the applicant since [ ]. The tribunal wrote to the applicant on [ ] and [ ]. No response was received to either of those letters.
3. Paragraph 11 of the Scheme provides “no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise.”
Decision
4. The tribunal has had no contact from the applicant since the application form was submitted. It is for the applicant to establish his case and that has not been done in this claim. Further, the applicant has not responded to correspondence from the tribunal and all reasonable assistance has not been provided. In all the circumstances I make no award.
