Facts

1. The applicant was assaulted while walking towards [ ] in [ ] on [ ]. He was brought to [ ] Hospital by ambulance where he underwent surgery. The matter was reported to the gardaí.


Engagement with the tribunal

2. The applicant wrote to the tribunal on [ ] stating that he had returned to work on [ ] and that he had no receipts as he had a medical card.

3. On [ ] the tribunal wrote to the applicant enquiring if he wished to pursue his application however no response was received.

4. Paragraph 11 of the Scheme provides "no compensation will be payable to an applicant who has not, in the opinion of the tribunal, given the tribunal all reasonable assistance, in relation to any medical report that it may require, and otherwise."


Decision

5. The applicant's claim is for loss of earnings as he does not appear to have any medical expenses. Unfortunately it is not possible to calculate the loss of earnings from the information provided and the applicant has not responded to correspondence from the tribunal. In such circumstances it is not possible to assess the claim. It is for the applicant to establish his case and that has not been done.
