Facts/brief background
1. [ ] (‘the applicant’) has made a claim for compensation under the Scheme of Compensation for Personal Injuries Criminally Inflicted (‘the Scheme’).
2. On the [ ], the applicant, alleges that he was assaulted by two males (‘the offenders’) for no reason outside [ ] and again on [ ]. The applicant was kicked and punched repeatedly.
3. The incident was reported to the Gardai in [ ]. The Gardai carried arrested the offenders, but the DPP recommended that no prosecutions should be pursued against them.
Injuries
4. The applicant sustained facial injuries and injuries to his body and elbow. He was treated in [ ] Hospital and in the [ ] Clinic.
Heads of loss
5. The applicant has put forward vouched medical expenses in the sum of €496.72.
Decision
6. It is not within the remit of the Tribunal to award compensation for pain and suffering under the terms and conditions of the Scheme. Instead, the Tribunal can only make awards in respect of the out-of-pocket expenses presented. Therefore, the Tribunal makes an award of €496.72 to the applicant.
